The Trailerix.com website (the "Service") is operated by Webmint s.r.o., registered office Jana Zelivskeho 2, Prague, Czech Republic, EU (the "Operator"). The Operator can be reached at [email protected].
2. Acceptance of Terms
By accessing or using the Service you agree to be bound by these Terms of Use, our Privacy Policy and applicable law of the European Union, the Czech Republic and — where you reside in the United States — applicable U.S. federal and state law. If you do not agree, you must not use the Service.
3. Nature of the Service
The Service aggregates publicly available trailers and metadata about films and television productions. Videos are streamed from third-party platforms (e.g., YouTube via embedded players). The Operator does not host, encode or distribute video content.
4. Intellectual Property
All trademarks, posters, stills, character designs and trailer footage are the property of their respective owners. Movie metadata is provided in part by The Movie Database (TMDB) and Kinocheck under their respective licenses; required attribution is shown on the Service. Editorial copy and translations on Trailerix.com are © Trailerix and may not be reproduced without permission.
5. User-Generated Content (Comments)
Comments posted by users are subject to moderation. By submitting a comment you grant the Operator a worldwide, royalty-free, non-exclusive license to display, store and distribute the content on the Service. You warrant that the content does not infringe any third-party rights, is not unlawful, hateful, threatening, defamatory, obscene or otherwise objectionable. The Operator reserves the right to remove any content at its sole discretion.
6. Acceptable Use
- No automated scraping that exceeds reasonable rate limits;
- No attempts to access non-public areas of the Service;
- No interference with the Service’s availability or integrity;
- No use of the Service in violation of EU, U.S. or other applicable law (including export control and sanctions law).
7. Open API
Use of the Trailerix Open API requires registration and acceptance of the additional API terms displayed on the documentation page. API keys may be revoked at any time without notice for breach of these Terms.
8. Disclaimers (DMCA, Section 230, EU)
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. Pursuant to 17 U.S.C. §512 (DMCA), notices of alleged copyright infringement should be sent to the email above; we will respond and, where appropriate, remove or disable access to the material. Pursuant to Article 14 of Directive 2000/31/EC and the EU Digital Services Act, the Operator acts as a hosting provider for user-generated comments and not as a publisher of third-party content. We comply with the Online Safety Act 2023 (UK) where relevant.
9. Limitation of Liability
To the maximum extent permitted by law, the Operator’s aggregate liability arising out of or relating to the Service shall not exceed EUR 100. The Operator is not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits or data.
10. Children
The Service is not directed to children under the age of 13 (or 16 where required by Article 8 GDPR). Children must obtain parental consent before submitting any personal data.
11. Termination
The Operator may suspend or terminate access at any time. Sections 4, 5, 8, 9, 12 and 13 survive termination.
12. Governing Law
These Terms are governed by the laws of the Czech Republic and the European Union, without regard to conflict of law principles. The competent courts are those of Prague, Czech Republic. Nothing in this clause limits any consumer rights mandated by your local law.
13. Changes
The Operator may revise these Terms; the current version is always posted on this page. Continued use of the Service after changes constitutes acceptance.
